Cancellation and Refund Policy
Introduction
Any Underwrite terms used but not defined here in shall have the meaning assigned to them under the Terms of Use which govern your use of our website www.eatofine.com (the “Website”) and our ‘Eatofine’ application for mobile and handheld devices (the “App”). The Website and the App are jointly referred to as the “Platform”
This Refund and Cancellation Policy ("Policy") sets forth the terms and conditions under which refunds and cancellations shall be processed for orders placed through Eatofine ("Company"). By placing an order through the Company’s platform, you ("User") agree to be bound by this Policy.
1.1. Orders once placed by a user ("User") on the Platform are considered final and binding. Cancellation of confirmed orders by the User is not permitted under the standard company policy.
1.2. The User shall have the right to cancel an order, before getting confirmed by Restaurant/Vendor Partner. Once it’s accepted or confirmed by the Restaurant/Vendor Partner, the order placed by user, can not be cancelled.
1.4. In the event of a unilateral cancellation by the User after placing an order, Eatofine reserves the right to levy a cancellation charge equivalent to 100% of the total order value. This is deemed necessary to compensate for the loss incurred due to breach of contractual obligations by the User.
1.5. In cases of prepaid orders, the order amount may not be refunded. For postpaid orders, the penalty may be recovered through subsequent transactions by the User.
1.6. In the event that an order is canceled by the restaurant or delivery partner due to unforeseen circumstances, the User shall be entitled to receive a full refund of the order amount.
2. Company-Initiated Cancellations
2.1. Eatofine reserves the right to cancel orders under circumstances beyond its control, including but not limited to:
- Inaccurate or insufficient delivery information provided by the User;
- Delivery location falling outside of the designated service zone;
- Inability to contact the User at the time of delivery;
- Non-availability of ordered items or delivery personnel.
2.2. If cancellation is necessitated due to reasons solely attributable to Eatofine or its delivery associates (such as inventory shortfalls or delivery personnel unavailability), no penalties shall be imposed on the User.
2.3. Delays in delivery alone shall not constitute grounds for refund eligibility unless explicitly determined otherwise by Eatofine.
3. Refunds
3.1. Refunds may be issued for prepaid orders under the following circumstances, subject to Eatofine’s verification:
- Non-delivery of the order by the delivery associate;
- Receipt of items that are of unsatisfactory quality;
- Tampered or damaged packaging;
- Incomplete or incorrect orders.
3.2. Eatofine retains the discretion to offer full or partial refunds based on the specifics of each case. The User shall notify the Company’s User support within thirty (30) minutes of delivery. Subject to verification, the Company may, at its sole discretion, issue a partial or full refund. Refunds shall be processed only after thorough review and validation by Eatofine.
3.3. If an order is rejected at the time of delivery due to genuine issues related to packaging or content, the User shall not be liable to pay for the order, and an appropriate refund (up to 100%) may be issued.
3.4. Refunds, where applicable, shall be processed to the original method of payment within 3–4 working days.
4. Disclaimers
4.1. Acceptance Confirmation:
Users are required to confirm order receipt via the App at the time of delivery. Once confirmed, no refund or cancellation claims will be entertained.
4.2. Restaurant/Vendor Partner Liability:
Any claims related to counterfeit, defective, or unsatisfactory products are the sole responsibility of the respective Restaurant/Vendor Partner. Eatofine serves only as a facilitation platform and shall not bear any liability in such cases.
4.3. Policy Subject to Change:
The Company reserves the right to amend, modify, or update this Policy at its sole discretion and without prior notice. The User is advised to review this Policy periodically for any changes.
4.4. Governing Law and Jurisdiction:
This Policy shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with this Policy shall be subject to the exclusive jurisdiction of the courts located within Faridabad.
